Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to specified conditions.

Summary

The petitioner, Basdev Manjhi, was arrested in connection with the seizure of 235 liters of illicit liquor, 90 liters of which were recovered from his hut, under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022. He had been in custody since 14 October 2025 and claimed innocence, offering to donate Rs. 25,000 to a charitable organization without admitting guilt. The State opposed his bail application. The Court, after considering the facts and submissions, ordered his release on bail upon furnishing a bail bond of Rs. 10,000 with two sureties of the same amount, and conditioned the bail on the deposit of Rs. 25,000 in the Ramakrishna Mission Ashram, Muzaffarpur, with proof of receipt. The bail bonds were to be accepted after verification of the receipt. The order effectively granted bail to the petitioner.
