DISMISSED

Holding

Bail was denied as the court found the petitioner’s criminal antecedents and the seriousness of the allegations warranted dismissal of the application.

Summary

The petitioner, Chunchun Singh, applied for bail in a case (PS Case No. 70/2025) involving alleged offences under Sections 140(1), 140(2) and 61(2) of the B.N.S. The prosecution alleged that the informant’s husband was abducted, a ransom of Rs. 5 lakh was demanded, and he was brutally assaulted by the accused. The petitioner claimed innocence, asserting that he was falsely implicated and has been in custody since 23‑08‑2025, though he possesses six prior criminal antecedents. The learned counsel for the petitioner argued that there was no specific overt act linking him to the crime. The court examined the seriousness of the allegations, the petitioner’s criminal record, and the lack of concrete evidence against him. Considering these factors, the bench dismissed the bail application.

  • Whether bail should be granted to the petitioner under Sections 140(1), 140(2) and 61(2) of the B.N.S. in view of the alleged ransom kidnapping and the petitioner’s criminal antecedents
