Patna High Court

Munna GiriversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, directing him to furnish a bond of Rs.10,000 with two sureties.

Summary

Munna Giri was arrested in connection with a case registered under Sections 126(2), 115(2), 109(1), 352 and 351(2) of the Bihar Negotiable Instruments Act, alleged to have assaulted a victim. He has been in custody since 23 February 2026 and claims he was falsely implicated. The State opposed his bail application, while his counsel argued his innocence and the lack of any flight risk. The Court examined the facts, the nature of the offences and the submissions of both parties. It ordered that the petitioner be released on bail upon furnishing a bond of Rs.10,000 with two sureties of the same amount, subject to the satisfaction of the concerned court. The bail order effectively disposed of the petition.

Issues considered

  • What is the appropriateness of granting bail to the petitioner in a case involving offences under Sections 126(2), 115(2), 109(1), 352 and 351(2) of the Bihar Negotiable Instruments Act?
  • Whether the petitioner’s claim of false implication and the circumstances of his custody justify bail?
