Bail is granted to the petitioner subject to the conditions imposed by the Court.
Summary
The petitioner Ravi Ranjan Singh was arrested on 8 August 2022 in connection with a robbery case (offence under Section 392 of the Indian Penal Code) registered as Daudpur PS Case No. 84 of 2021. The FIR originally named an unknown offender; the petitioner’s name was later added based on a confessional statement of co‑accused Raja Sharma, and no material was recovered from him. The petitioner has 18 other criminal cases, of which 15 are on bail and three are pending before other courts. The State opposed bail, citing the seriousness of the offence and the petitioner’s extensive criminal antecedents. The Court, after noting the long period of pre‑trial custody, the lack of material evidence and the petitioner’s willingness to cooperate, granted bail on a bond of Rs 10,000 with two sureties and imposed conditions regarding personal appearance, non‑tampering with evidence and verification of antecedents, directing the order to the Judicial Magistrate, First Class, Saran.
Issues considered
- Whether bail should be granted to an accused of robbery under Section 392 IPC after prolonged pre‑trial detention.
- Whether the petitioner’s criminal antecedents and the manner in which his name was added to the FIR affect the bail decision.
