BAIL GRANTED

Holding

The court held that bail could be granted in the present case, subject to monetary and reporting conditions, despite the seriousness of the alleged offence.

Summary

The petitioner was arrested in connection with a case under section 30(d) of the Bihar Prohibition & Excise Act for allegedly using 15 tins of jaggery to manufacture illicit liquor, with material seized from a tempo and a bush. The petitioner claimed innocence and had been in custody since 2 December 2025, offering to donate Rs.25,000 to charity without admitting guilt. The State opposed bail, but the court considered the nature of the seized material and the length of pre‑trial detention. The court allowed the bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties and to deposit Rs.25,000 with the Ramakrishna Mission Ashram, producing a receipt. Additional conditions included reporting to the police station on the first and third Sundays of each month, with default leading to cancellation of bail. The order was limited to the bail application and did not prejudice the merits of the trial.

Issues considered

  • Whether the petitioner is entitled to bail in a case under section 30(d) of the Bihar Prohibition & Excise Act considering the material recovered and period of custody?
