The court granted regular bail to the petitioner, directing his release upon furnishing a bail bond of Rs.10,000 with two sureties.

Summary

The petitioner, Rinku (also known as Md. Faiyaz), was arrested in connection with a case of alleged illegal arms manufacturing under several provisions of the Arms Act. Police conducted a raid based on a tip, but the accused fled; a local chowkidar identified 33 persons, including the petitioner, though no weapons were recovered from him. The petitioner argued innocence, noting that no material was found on him and that co‑accused had previously been granted bail in similar cases. The State opposed bail, citing three prior criminal cases against the petitioner. After hearing both sides, the court found the petitioner’s situation comparable to the co‑accused and, despite the antecedents, ordered his release on regular bail with a bond of Rs.10,000 and two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail under the Arms Act despite the seriousness of the alleged offence.
  • Whether the petitioner’s prior criminal antecedents preclude the grant of bail.
  • Whether mere identification by a chowkidar, without seizure of arms, justifies continued detention.
