Kamla ManjhiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner subject to a bond of Rs 10,000 and the conditions stipulated by the Court.

Summary

Kamla Manjhi was arrested on 22 February 2026 for alleged possession of 50 litres of illegal liquor, an offence under Section 30(a) of the Bihar Prohibition and Excise Amendment Act. The petitioner argued that he has a clean antecedent, that the seizure was made at the place of occurrence, and that the prosecution’s witnesses were Home Guard personnel, thereby violating mandatory provisions of Sections 103 and 105 of the BNSS, 2023. The State opposed bail, contending the seriousness of the offence. The Court, after considering the facts, granted bail on a bond of Rs 10,000 with two sureties, imposing conditions of cooperation, appearance, non‑tampering with evidence, and verification of antecedents. The bail order was directed to be implemented by the Special Excise Judge, Saran.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Amendment Act considering alleged procedural lapses under Sections 103 and 105 of BNSS, 2023.
  • Whether the petitioner’s clean antecedent and the nature of the seizure justify bail despite the seriousness of the offence.
