BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to the stipulated conditions.

Summary

Ganesh Ray applied for anticipatory bail fearing arrest in a case (Bheldi P.S. Case No. 127 of 2026) under Section 30(a) of the Bihar Prohibition and Excise Act alleging possession of 3 litres of illicit liquor. The prosecution alleged the liquor belonged to the petitioner, while he claimed innocence and offered to donate Rs.25,000 to a charitable organization without admitting guilt. The High Court, noting that the petitioner was not caught in the act, granted anticipatory bail on a bond of Rs.10,000 with two sureties, conditioned on the donation, regular attendance at the police station every Sunday, and compliance with Section 438(2) of the CrPC and Section 482 of the BNSS. The order expressly limited its effect to the bail application and did not prejudice the merits of the trial. The bail bonds are to be verified upon production of the donation receipt.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438(2) of the CrPC in the context of the alleged offence under the Bihar Prohibition and Excise Act.
  • Whether the conditions imposed, including a charitable donation and regular police station attendance, are appropriate and lawful.
