Holding
The Court held that anticipatory bail is appropriate given the petitioner’s clean antecedent and lack of direct possession, and granted bail with specified conditions.
Summary
The petitioner, Amit Kumar, was implicated in a case involving the seizure of 4,392.36 litres of English liquor from two trucks, alleged to be in violation of Sections 30(a), 32 and 41(1) of the Bihar Prohibition and Excise (Amendment) Act. He argued that he had no conscious possession, was neither the owner nor driver of the trucks, and that the seizure violated mandatory procedures under Section 100 of the CrPC and Section 103 of the BNSS, 2023. The State opposed bail, invoking Section 76(2) of the Prohibition Act, claiming pre‑arrest bail was not permissible. Relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar (2019) and considering the petitioner’s clean antecedent, the Court granted anticipatory bail with a bond of Rs 10,000 and two sureties, subject to conditions under Section 438(2) CrPC and Section 482(2) BNSS, 2023. The order also imposed compliance conditions and provisions for bail cancellation on tampering or non‑appearance.
Issues considered
- Whether anticipatory bail can be granted to a person accused under the Bihar Prohibition and Excise (Amendment) Act despite Section 76(2) of the Act.
- Whether the petitioner’s lack of conscious possession and alleged procedural lapses in seizure justify granting bail.
- Whether the provisions of Section 438 CrPC and Section 482(2) BNSS, 2023 are applicable in this context.
