Patna High Court

Gumgum Sah @ Gumgom Sah @ Lal Bihari SahversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted subject to conditions.

Summary

The Patna High Court heard a bail application filed by Gumgum Sah, who has been in custody since 9 February 2026 in connection with a case under Section 30(a) of the Bihar Prohibition & Excise Act for alleged possession of 54 litres of foreign liquor. The liquor was seized from the house of a co‑accused, not from the petitioner’s conscious possession, and the only identification against him was the testimony of a local chaukidar. The petitioner argued that he was falsely implicated and that no material evidence linked him to the contraband. The State opposed bail, noting two other similar pending cases against the petitioner, although he was already on bail in one of them. Considering that the recovery was not from his possession and that the identification was weak, the court ordered his release on bail with a bond of Rs 10,000 and two sureties, subject to conditions of cooperation, non‑tampering with evidence, and verification of criminal antecedents, and directed that acceptance of the bail bond not be delayed for verification.

Issues considered

  • Whether bail should be granted when the alleged contraband was not recovered from the accused’s possession and identification is solely based on a local chaukidar’s statement
  • Whether the existence of other pending cases of a similar nature bars the grant of bail

                                4. Learned counsel for the petitioner submits that the

petitioner is innocent and he has been falsely implicated in the

present case. He further submits that it appears from the F.I.R.

as well as seizure list that nothing has been recovered from the

allegation in the F.I.R. the petitioner fled away from the place of

petitioner and the petitioner is in custody since 09.02.2026.

State has vehemently opposed the prayer for bail of the

petitioner and submits that the petitioner carries two more cases

of similar nature other than the present one but fairly submits on

the basis of paragraph-3 of the bail petition that the petitioner is

on bail in the pending matter.

                       6. Considering the facts and circumstances of the case

and the fact that nothing has been recovered from the conscious
