The court granted regular bail to the petitioner with specified conditions.
Summary
The petitioner was arrested on 17‑04‑2026 for alleged possession of 60 litres of illicit country‑made liquor seized from a motorcycle, an offence under section 30(a) of the Bihar Prohibition & Excise Act. He claimed innocence, asserted a clean criminal record, and offered to donate Rs.25,000 to a charitable organization without pleading guilty. The State opposed the bail application. The High Court, after considering the facts and submissions, granted regular bail subject to a cash bond of Rs.10,000 with two sureties of equal amount, verification of the petitioner’s clean antecedent, deposit of the charitable donation, and a condition to appear at the police station every Sunday. The bail bonds would be cancelled upon any default in appearance. The order was pronounced by Justice Sandeep Kumar.
Issues considered
- Whether bail should be granted to a person accused under section 30(a) of the Bihar Prohibition & Excise Act for possession of illicit liquor.
- Whether the conditions imposed by the court, including a charitable donation, sureties, verification of antecedents, and regular police‑station attendance, are lawful and appropriate.
