Patna High Court

ASHIS VERMA @ ASHIS KUMARversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The court denied anticipatory bail to the petitioner.

Summary

Ashis Verma (also known as Ashis Kumar) feared arrest in a case registered under Sections 457 and 380 of the Indian Penal Code for alleged theft of ornaments from an informant's house. The FIR was initially lodged against an unknown person, but the investigation identified the petitioner as having purchased stolen articles and possessing two prior similar criminal antecedents. The petitioner filed an application for anticipatory bail, arguing that his arrest would be unwarranted given the circumstances. The learned counsel for the State opposed the bail, highlighting the seriousness of the offences and the petitioner’s past conduct. After hearing both sides, the Patna High Court, presided by Justice Prabhat Kumar Singh, rejected the anticipatory bail application, concluding that the petitioner’s antecedents and the nature of the charges did not merit such relief.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the circumstances of the case
  • Whether the petitioner’s prior criminal antecedents and the nature of the offences justify denial of anticipatory bail
