Patna High Court

Ram Vilash ChaupalversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner on condition of a bail bond and sureties.

Summary

Ram Vilash Chaupal was arrested in connection with a case (PS 507 of 2020) alleging offences under several sections of the Indian Penal Code, including murder, robbery and assault, stemming from a fight between two families. The petitioner contended that he was falsely implicated due to a trivial dispute between the families and that the FIR contained only general, omnibus allegations against him. He had been in custody since 29 November 2025 and applied for regular bail, undertaking to cooperate with the investigation. The State opposed the bail application. After hearing both sides and considering the nature of the allegations, the court decided to grant bail, subject to a bond of Rs.10,000 and two sureties of the same amount, to be satisfied by the Additional Chief Judicial Magistrate-II, Jhanjharpur, Madhubani.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious charges under the IPC.
  • Whether the allegations against the petitioner are sufficient to justify continued detention.
