The court granted regular bail to the petitioner.

Summary

Chandrika Paswan, a 74‑year‑old petitioner, was arrested in connection with a case (PS‑536/2025) alleging that she, along with others, assaulted the father of an informant with a lathi, danda and bricks, resulting in his death. The prosecution charged her under sections 190, 191(2), 191(3), 115(2), 109(1) and 103(1) of the Bihar Penal Code. The petitioner contended that she was falsely implicated, that the allegations were vague, and that the post‑mortem report showed only simple injuries on the right side of the body, suggesting the death was due to a fall rather than the alleged assault. She also highlighted her advanced age, lack of prior criminal record, and that she had been in judicial custody since 19‑09‑2025. The State opposed the bail application, but the court, after considering the medical evidence, the petitioner’s age and clean record, ordered that she be released on regular bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether regular bail should be granted to the petitioner despite the serious nature of the charges.
  • Whether the medical evidence creates reasonable doubt about the petitioner’s involvement in the death.
  • Whether the petitioner’s age and lack of criminal antecedents warrant bail.

Subjects

  • bail
  • criminal procedure
  • assault
  • homicide
  • age
