Holding
The court denied regular bail to the petitioners.
Summary
The petitioners, Shivdatt Ravidas and Deepak Kumar Ravidas, were charged under Sections 126(2), 115(2), 103(1), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 for allegedly assaulting and killing a person. They applied for regular bail, claiming innocence and that six examined witnesses did not support the prosecution. The State opposed bail, emphasizing the seriousness of the offences and that the trial had already commenced. The court, relying on the Supreme Court’s decision in X vs State of Rajasthan & Anr (2024 SCC OnLine SC 3539), found the allegations serious enough to deny bail. Consequently, the bail application was rejected.
Issues considered
- Whether regular bail should be granted to accused persons facing serious offences under the Bharatiya Nyaya Sanhita, 2023.
- Whether the existence of six non‑supportive witnesses is sufficient to justify bail.
