Patna High Court

Md. Nashruddin @ Mohammad NasaruddinversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner’s involvement is only prima facie suspicion and, having been in custody for an extended period, he is entitled to bail.

Summary

The petitioner, Md. Nashruddin, was arrested in connection with a murder arising from a land dispute and charged under several IPC sections including 147, 148, 149, 341, 323, 302 and 506. He has been in custody since 21 May 2024 based largely on the informant’s suspicion, with no eyewitness testimony. The petitioner’s counsel argued that there is no incriminating material against him, highlighted his clean antecedents, and pointed out that a co‑accused had already been granted bail. The State opposed bail, citing the seriousness of the offences. The court observed that the case against the petitioner is prima facie only suspicion, noted the prolonged pre‑trial detention, and consequently ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to conditions under Section 437(3) of the Cr.P.C. and Section 480(3) of the BNSS.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences alleged.
  • Whether the petitioner’s continued detention amounts to an unreasonable pre‑trial incarceration given the lack of incriminating evidence.
