Amod ChaudharyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, subject to bond and conditions.

Summary

Amod Chaudhary was arrested on 13 September 2025 in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act for the alleged possession of two litres of illicit liquor seized from his house. The petitioner contended that the liquor was not in his conscious possession and that he was falsely implicated, citing lack of compliance with Sections 100 and 103 of the Criminal Procedure Code during the seizure. The prosecution opposed bail, highlighting three prior criminal antecedents, though the petitioner was already on bail for those matters. The court examined the facts, noted the absence of conscious possession and the procedural lapses, and ordered the release of the petitioner on bail with a bond of Rs. 10,000 and two sureties, subject to conditions of cooperation, non‑tampering with evidence, and verification of antecedents. The bail order was directed to be implemented without delay for verification purposes.

Issues considered

  • Whether bail should be granted to the petitioner despite alleged non‑compliance with Sections 100 and 103 of the CrPC during seizure.
  • Whether the petitioner’s prior criminal antecedents preclude the grant of bail in the present case.
