Holding

The court held that the petitioner is entitled to bail in the present case.

Summary

The petitioner, Ranjan Kumar, was arrested in connection with a case registered under Sections 308(5) and 3(5) of the B.N.S., alleged to have been involved with armed miscreants demanding a levy. He contended that he was falsely implicated and that his name appeared only in the confessional statement of co‑accused Rahul Kumar, who had already been granted bail. The State opposed bail, citing three prior criminal cases against the petitioner. The court examined the circumstances, the co‑accused’s confession, and the petitioner’s prolonged custody since 16‑09‑2025. Finding that the prosecution’s case was not strong enough to deny bail, the court ordered the petitioner to be released on bail with a bond of Rs. 10,000 and two sureties. The order was directed to be implemented by the Judicial Magistrate, 1st Class, Gaya.

Issues considered

  • Whether the petitioner is entitled to bail despite the allegations under Sections 308(5) and 3(5) of the B.N.S.
  • Whether the petitioner’s prior criminal antecedents justify denial of bail
