Patna High Court

SANJAY KUMAR RAMversusSTATE OF BIHAR

Decided
Disposal
ABATED

Holding

The appeal stands abated and is disposed of as the appellant is deceased and no near relative applied for leave to continue.

Summary

The appellant Sanjay Kumar Ram filed a criminal appeal before the Patna High Court. Subsequent police reports confirmed that the appellant had died, and a death certificate was attached. The court examined whether the appeal could proceed after the appellant's death without any application from a near relative. Relying on Section 394 of the Code of Criminal Procedure, 1973 (corresponding to Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023), the court held that in such circumstances the appeal abates. Consequently, the appeal was disposed of, and the trial court record was ordered to be sent back to the lower court.
