Patna High Court

NARESH PRASADversusSTATE OF BIHAR

Decided
Disposal
ABATED

Holding

The appeal is abated and disposed of under Section 394 CrPC (Section 435 B.N.S.) because the appellant died and no relative sought its continuation.

Summary

The appellant, Naresh Prasad, filed a criminal appeal (DB) No. 1069 of 2007 before the Patna High Court. During the pendency of the appeal, the appellant died, as confirmed by official letters and a death certificate. No near relative filed an application for leave to continue the appeal. The Court examined Section 394 of the Code of Criminal Procedure, 1973 (corresponding to Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023), which provides that an appeal abates on the death of the appellant if no relative seeks its continuation. Accordingly, the Court held that the appeal stands abated and ordered its disposal, directing the trial court record to be sent back to the concerned court.
