Patna High Court

BALDEO MAHTOversusTHE STATE OF BIHAR

Decided
Disposal
ABATED

Holding

The appeal abates and is disposed of because the appellant is deceased and no near relative applied for leave to continue the appeal.

Summary

The appellant, Baldeo Mahto, filed a criminal appeal (Cr. App. DB No.1201 of 2011) arising from a 2004 case. During the pendency of the appeal, the appellant died, as confirmed by a death certificate annexed to a police report. The court examined whether the appeal could continue in the absence of a filing by any near relative. Relying on Section 394 of the Code of Criminal Procedure, 1973, which mirrors Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the court held that an appeal abates if no relative seeks leave to continue it. Consequently, the appeal was abated and the matter was disposed of, with the trial court record to be returned to the lower court.
