Holding
The criminal appeal stands abated and is disposed of due to the death of the sole appellant without any application by a near relative.
Summary
The appellant, Ram Awatar Mahto, filed a criminal appeal (Cr. App. DB No.1247 of 2011) before the Patna High Court. During the pendency of the appeal, the Supreme Court learned from a police letter and report that the sole appellant had died. No near relative filed an application for leave to continue the appeal. Under Section 394 of the Code of Criminal Procedure, 1973 (corresponding to Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023), an appeal cannot proceed in the absence of a party or a representative. Consequently, the Court held that the appeal stands abated and is disposed of. The trial court record was directed to be sent back to the concerned court.
