Holding

A criminal appeal abates when the sole appellant dies during its pendency.

Summary

Babu Lal Mahto filed a criminal appeal (DB) No.137 of 2000 before the Patna High Court. While the appeal was pending, the Superintendent of Police submitted a report confirming that the sole appellant had died on 17-12-2025. The court was required to determine the effect of the appellant's death on the pending criminal appeal. Applying the principle that a criminal appeal abates upon the death of the appellant, the court held that the appeal could not continue. Consequently, the appeal was declared abated and the matter was consigned to the record.
