Decided

Holding

The appeal stands abated under Section 394 CrPC (Section 435 BHSS 2023) as no near relative filed an application for leave to continue.

Summary

The appellants, Sarvajeet Rai and Ram Sakal Rai, died during the pendency of Criminal Appeal No.189 of 2008 before the Patna High Court. The court examined a police letter and death certificate confirming their deaths. Under Section 394 of the Code of Criminal Procedure, 1973 (corresponding to Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023), an appeal is abated if no near relative files an application for leave to continue. Since no such application was filed, the court held that the appeal could not proceed. Consequently, the appeal was abated and disposed of, and the trial court records were ordered to be sent back to the concerned court.
