Patna High Court

PRAKASH SHARMAversusTHE STATE OF BIHAR

Decided
Disposal
ABATED

Holding

The appeal abates upon the appellant's death, and the discretionary fine imposed under Section 302 is set aside.

Summary

The appellant, Prakash Sharma, was convicted under Section 302 of the Indian Penal Code and a fine was imposed by the trial court. While the appeal was pending, the appellant died, as confirmed by a police letter and a death certificate. No near relative filed an application for leave to continue the appeal, invoking Section 394 of the Code of Criminal Procedure (now Section 435 of the Bharatiya Nagarik Suraksha Sanhita). The Court noted that the imposition of a fine in a Section 302 conviction is discretionary, not mandatory, as held in Santosh Kumar Baranwal v. State of UP and Gopala Balu Kamble v. State of Maharashtra. Since the State did not intend to recover the fine and the appellant was deceased, the Court set aside the fine order and held that the appeal abated in its entirety. The trial court records were ordered to be sent back to the concerned court.

Issues considered

  • What is the effect of the appellant's death on a pending criminal appeal and the imposed fine?
  • Whether the discretionary fine imposed under a Section 302 conviction can be set aside upon the appellant's death?
