Holding

The appeal stands abated and is disposed of due to the appellant's death and lack of application by a near relative.

Summary

The appellant, Makeshwar Pandey, filed a criminal appeal (DB) No.250 of 2014 before the Patna High Court. During the pendency of the appeal, the Superintendent of Police informed the Court that the appellant had died. The Court examined Section 394 of the Code of Criminal Procedure, 1973 (equivalent to Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023), which provides for abatement of criminal proceedings upon the death of the accused. Since no near relative applied for leave to continue the appeal, the Court held that the appeal could not proceed. Consequently, the appeal was abated and disposed of, and the trial court records were ordered to be sent back to the trial court.
