Patna High Court

MAHENDRA PRASAD YADAVversusSTATE OF BIHAR

Decided
Disposal
ABATED

Holding

The appeal stands abated and is disposed of because the appellant died and no near relative applied for leave to continue the appeal under Section 394 CrPC.

Summary

The appellant Mahendra Prasad Yadav filed a criminal appeal, but during the pendency the appellant died, as evidenced by a death certificate dated 14-10-2022. The Senior Superintendent of Police submitted a letter and the SHO's report confirming the death. No near relative filed an application for leave to continue the appeal. Pursuant to Section 394 of the Code of Criminal Procedure, 1973 (corresponding to Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023), the court held that the appeal cannot proceed without such an application. Consequently, the appeal was deemed abated and disposed of.
