Patna High Court

RAMAN BHAGAT and ORSversusSTATE OF BIHAR

Decided
Disposal
DISPOSED

Holding

The appeal stands abated and is disposed of due to the death of the appellants and the absence of any application by a near relative.

Summary

The appellants Raman Bhagat, Dhaneshwar Bhagat and Chandrama Devi were reported dead by the Superintendent of Police. The High Court considered whether the criminal appeal could proceed in the absence of any near relative filing an application to continue the appeal. Relying on Section 394 of the Code of Criminal Procedure, 1973 (corresponding to Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023), the Court held that without such an application the appeal cannot be pursued. Consequently, the appeal was deemed abated. The Court therefore disposed of the appeal.
