BINOD DASversusSTATE OF BIHAR

Decided
Disposal
ABATED

Holding

The criminal appeal stands abated and is disposed of due to the appellant's death and lack of any application to continue.

Summary

The appellant, Binod Das, filed a criminal appeal (DB) No.409 of 2010 before the Patna High Court. During the pendency of the appeal, the appellant died, as confirmed by police reports and a death certificate annexed to the record. No near relative filed an application for leave to continue the appeal after his death. The Court examined Section 394 of the Code of Criminal Procedure, 1973, which is mirrored by Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023, governing abatement of proceedings upon the death of a party. In the absence of any application to continue, the Court held that the appeal stands abated. Consequently, the appeal was disposed of, and the trial court record was ordered to be sent back to the lower court.
