Patna High Court

LAL BACHAN PANDEYversusSTATE OF BIHAR

Decided
Disposal
ABATED

Holding

The criminal appeal stands abated due to the appellant’s death, as no near relative applied for leave to continue it.

Summary

The appellant, Lal Bachan Pandey, filed a criminal appeal against the State of Bihar. During the pendency of the appeal, the appellant died, as confirmed by a death certificate and police reports. No near relative filed an application for leave to continue the appeal. The Court examined Section 394 of the Code of Criminal Procedure, 1973 (corresponding to Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023), which provides that an appeal abates on the death of the appellant unless a relative seeks its continuation. Consequently, the Court held that the appeal stands abated and ordered it disposed of, directing the trial court records to be sent back. The decision underscores the procedural rule that an appeal cannot proceed after the appellant’s death without a relative’s intervention.

Issues considered

  • Does the death of an appellant automatically abate a criminal appeal under the procedural law?
  • Is an application by a near relative required to continue the appeal after the appellant’s death?
