Patna High Court

Mahesh MandalversusThe State Of Bihar

Decided
Disposal
ABATED

Holding

The appeal abates and is disposed of because the appellant died and no near relative applied for leave to continue the appeal.

Summary

The appellant, Mahesh Mandal, filed a criminal appeal (DB) No.46 of 2015. During the pendency of the appeal, the appellant was found to be deceased, as reported by the Superintendent of Police and the investigating officer. The court examined Section 394 of the Code of Criminal Procedure, 1973 (corresponding to Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023), which provides that an appeal abates on the death of the appellant unless a near relative applies for leave to continue. No such application was filed by any near relative. Consequently, the court held that the appeal stood abated and ordered its disposal, directing the trial court records to be sent back.
