Holding

The appeal stands abated and is disposed of under Section 394 CrPC (Section 435 B.N.S. 2023) due to the appellant's death and lack of application by a near relative.

Summary

The appellant Krishna Prasad filed a criminal appeal against the State of Bihar. During the pendency of the appeal, it was discovered that the appellant had died, as evidenced by a death certificate dated 30-09-2020. The Superintendent of Police and the SHO submitted reports confirming the death. No near relative filed an application for leave to continue the appeal.
