Patna High Court

KRISHNA MAHTOversusSTATE OF BIHAR

Decided
Disposal
ABATED

Holding

The appeal stands abated and is disposed of as no near relative applied for leave to continue it.

Summary

Krishna Mahto appealed against a conviction by the State of Bihar. While the appeal was pending, the Deputy Superintendent of Police filed an affidavit stating that the appellant had died. The court examined the effect of the appellant's death under Section 394 of the Code of Criminal Procedure, 1973 (corresponding to Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023). It held that, in the absence of an application by a near relative for leave to continue the appeal, the appeal cannot proceed. Consequently, the appeal was deemed abated and was disposed of by the court.
