Patna High Court

HARI MAHALDARversusSTATE OF BIHAR

Decided
Disposal
ABATED

Holding

The appeal stands abated and is disposed of as the appellant died and no near relative applied for leave to continue.

Summary

The appellant, Hari Mahaldar, died during the pendency of Criminal Appeal No. 532 of 2004 before the Patna High Court. The court examined a letter from the Senior Superintendent of Police and a police report confirming the appellant's death. The issue was whether the appeal could continue in the absence of a near relative filing an application for leave to continue. Relying on Section 394 of the Code of Criminal Procedure, 1973 (corresponding to Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023), the court held that the appeal abates if no relative applies. Consequently, the appeal was abated and disposed of, and the trial court records were ordered to be sent back to the lower court.
