Patna High Court

YOGENDRA YADAVversusTHE STATE OF BIHAR

Decided
Disposal
ABATED

Holding

The appeal is abated and disposed of because the appellant died and no near relative applied for leave to continue, as mandated by Section 394 of the CrPC and Section 435 of the Bharatiya Nagarik Suraksha Sanhita.

Summary

The appellant Yogendra Yadav filed a criminal appeal (DB) No.629 of 2011 before the Patna High Court. During the pendency of the appeal, the appellant died, as confirmed by a death certificate and police reports. No near relative filed an application for leave to continue the appeal after his death. The Court examined Section 394 of the Code of Criminal Procedure, 1973, which mirrors Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023, providing that an appeal abates on the death of the appellant unless a relative seeks permission to proceed. Consequently, the Court held that the appeal stands abated and ordered its disposal, directing the trial court records to be sent back. The order was pronounced by the Chief Justice and Justice Harish Kumar.

Issues considered
