The criminal appeal stands abated and is disposed of as no application for leave to continue has been filed.

Summary

The appellants Mahabir Mandan and Paltu Mandan filed a criminal appeal before the Patna High Court. During the pendency of the appeal, the Superintendent of Police reported that both appellants had died. No near relative filed an application for leave to continue the appeal. The Court, applying Section 394 of the Code of Criminal Procedure, 1973 (corresponding to Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023), held that in the absence of such an application the appeal must be abated. Consequently, the appeal was disposed of. The trial court record was ordered to be sent back to the lower court.
