Patna High Court

MD. ATAUR RAHMANversusSTATE OF BIHAR

Decided
Disposal
ABATED

Holding

The appeal stands abated and is disposed of as the appellant has died and no relative applied for leave to continue.

Summary

The appellant, Md. Ataur Rahman, died during the pendency of Criminal Appeal No.766 of 2010 before the Patna High Court. The court examined a police letter confirming the death and noted that no near relative had applied for leave to continue the appeal. Relying on Section 394 of the Code of Criminal Procedure, 1973 (corresponding to Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023), the court held that in the absence of such an application the appeal must be abated. Consequently, the appeal was disposed of. The trial court records were ordered to be sent back to the lower court.
