Patna High Court
SHIV SAGAR RAIversusTHE STATE OF BIHAR
- Decided
- Disposal
- ABATED
Holding
The appeal is abated due to the appellant's death, and the fine order is set aside as discretionary.
Summary
Shiv Sagar Rai appealed a conviction under Section 302 IPC, which included a fine, before the Patna High Court. During the pendency of the appeal, the appellant died, and no near relative filed an application to continue the appeal. The Court examined Section 394 of the CrPC (corresponding to Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023) regarding abatement of criminal appeals upon death, and noted that a fine imposed on conviction is discretionary, not mandatory, as held in Santosh Kumar Baranwal v. State of UP and Gopala Balu Kamble v. State of Maharashtra. Since the State did not intend to recover the fine and the appellant was deceased, the Court set aside the fine order and held that the appeal was wholly abated. The appeal was therefore disposed of as abated in its entirety, and the trial court records were to be sent back.
Issues considered
- The effect of the appellant's death on a pending criminal appeal.
- Whether the fine imposed under a conviction for murder is mandatory or discretionary.
- Whether an appeal can proceed without a near relative filing an application for leave to continue.
