Patna High Court

PAKHEUE MANDALversusSTATE OF BIHAR

Decided
Disposal
ABATED

Holding

The appeal stands abated because the appellant is dead and no near relative applied for leave to continue.

Summary

The appellant, Pakheue Mandal, was found to be deceased as per police reports dated 28-04-2026 and 29-04-2026. The High Court examined whether a criminal appeal could proceed when the appellant is dead. Under Section 394 of the Code of Criminal Procedure, 1973 (corresponding to Section 435 of the Bharatiya Nagarik Suraksha Sanhita, 2023), an appeal is abated if no near relative files an application for leave to continue. Since no such application was filed, the Court held that the appeal stands abated. Consequently, the appeal was disposed of, and the trial court record was ordered to be sent back to the concerned court.

Issues considered

  • Whether a criminal appeal can continue when the appellant is deceased
  • Whether Section 394 CrPC (or Section 435 B.N.S.) mandates abatement of the appeal in the absence of an application by a near relative
