Holding
The court held that the appellant is entitled to suspension of his sentence and bail pending the appeal due to the inordinate delay in hearing the appeal.
Summary
The appellant, convicted under Section 302 of the Indian Penal Code for stabbing the deceased, filed a criminal appeal in 2008 which had not been heard for about six years. He applied for suspension of his sentence and bail, arguing that the delay violated his right to a speedy trial. The High Court considered the length of custodial delay and the appellant's right to liberty pending the appeal. The Court ordered that his sentence be suspended and granted bail upon furnishing a bail bond of Rs.10,000 with two sureties. The application for interim relief was disposed of, allowing the appellant to remain out of custody while the appeal proceeds.
