Holding

The High Court set aside the order rejecting anticipatory bail and granted bail to the appellant.

Summary

Anand Kumar was charged under several IPC sections and the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act for allegedly abusing a caste name and assaulting an informant at a car showroom. The informant claimed the abuse occurred when he inquired about a car, while the appellant contended he was merely a sales consultant with no role in selling the vehicle and that no public was present, asserting his innocence and clean antecedent. The Special Judge had rejected his anticipatory bail application. On appeal, the Patna High Court examined whether the allegations amounted to an offence under the SC/ST Act and considered the bail criteria. Finding insufficient basis to deny bail, the Court set aside the lower court’s order and granted anticipatory bail to the appellant, subject to bond and sureties.

Issues considered

  • Whether the appellant's alleged conduct constitutes an offence punishable under the SC/ST (Prevention of Atrocities) Act.
  • Whether anticipatory bail should be granted to the appellant in view of the allegations and the statutory provisions.
