DISMISSED

Holding

The appeal is dismissed and anticipatory bail is denied to the appellant.

Summary

The appellant, Bikesh Paswan, was charged in a FIR for kidnapping and violently assaulting the son of informant Rinku Devi, allegedly snatching his money and inflicting multiple knife wounds. The prosecution alleged that the assault was caste‑based, invoking Sections of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and several provisions of the B.N.S. The appellant sought anticipatory bail, arguing that he was falsely implicated due to village politics and that no specific caste‑based allegation was made against him. The Special Judge rejected the bail application, and the appellant appealed to the Patna High Court. The High Court examined the specificity of the accusations, the gravity of the offences, and the seriousness of the injuries, concluding that the allegations were direct and serious. Consequently, the court dismissed the appeal and refused anticipatory bail.

Issues considered

  • Whether the appellant is entitled to anticipatory bail under the circumstances of the case
  • Whether the allegations against the appellant fall within the ambit of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act
  • Whether the specificity and gravity of the accusations justify denial of bail
