Holding

The court held that the appellant is entitled to bail despite the serious nature of the charges, as his alleged involvement was limited to concealing the body, and therefore set aside the order denying bail.

Summary

The appellant, Abhijeet Paswan, appealed against the Special Judge's order rejecting his bail application in a case involving murder and related offences under the IPC, Arms Act and SC/ST (POA) Act. He had been in custody since October 2025 and claimed innocence, asserting that he only helped conceal the body and was not the assailant. The State and the informant opposed bail, citing the seriousness of the charges including Sections 302, 307, 336, 201, 120B, 34 of the IPC and provisions of the Arms Act. The Patna High Court, after considering the nature of the allegations and the appellant's alleged role, allowed the bail application and set aside the earlier order. Consequently, the appellant was ordered to be released on bail upon furnishing a bond of Rs. 10,000 with two sureties of the same amount.

Issues considered

  • Whether bail can be granted to an accused charged with murder, attempt to murder, and other serious offences under the IPC, Arms Act and SC/ST (POA) Act.
  • Whether the appellant's alleged participation limited to concealing the body affects his eligibility for bail.
  • Whether the Special Judge's denial of bail was legally erroneous.
