Holding

The appeal is allowed and the order rejecting anticipatory bail is set aside, directing bail subject to statutory conditions.

Summary

The appellant, Rajesh Kumar Mishra, a government teacher, was charged under multiple sections of the B.N.S. and the SC/ST (POA) Act for alleged assault. He applied for anticipatory bail, which was rejected by the Special Judge. The appellant contended that he was falsely implicated and that no offence under the SC/ST Act was made out. The High Court, after considering the submissions and noting the appellant's status as a government servant, set aside the lower court's order rejecting anticipatory bail. The Court directed that the appellant be released on bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the B.N.S.

Issues considered

  • Whether anticipatory bail should be granted to the appellant under the circumstances.
  • Whether the alleged conduct constitutes an offence under the SC/ST (POA) Act.
  • Whether the appellant's position as a government servant influences the grant of bail.
