The High Court allowed the appeal, set aside the order rejecting anticipatory bail, and granted bail to the appellant.
Summary
The appellant, Nagmani Prasad, was charged under several IPC sections and Section 3(1)(r)(s) of the SC/ST (Prevention of Atrocities) Act for allegedly assaulting an informant on 4 April 2021. He applied for anticipatory bail, which was rejected by the Special Judge on 3 July 2021. The appellant contended that the allegations were vague, that no specific overt act could be linked to him, and that the incident did not occur in public view, thus not attracting the SC/ST Act. The prosecution opposed bail, emphasizing the seriousness of the offences. The High Court, noting the nature of the accusation, the appellant’s clean antecedent, and the lack of concrete evidence tying him to the assault, ordered that bail be granted upon surrender within eight weeks with a bond of Rs 10,000 and two sureties. Consequently, the appeal was allowed and the lower court’s order was set aside for the appellant alone.
Issues considered
- Whether the allegations against the appellant constitute an offence under the SC/ST (Prevention of Atrocities) Act, Section 3(1)(r)(s).
- Whether anticipatory bail should be granted in view of the charges under IPC sections 341, 323, 325, 504, 506 and the SC/ST Act.
- Whether the appellant’s clean antecedent and the nature of the accusation justify bail.
