Patna High Court

Om Prakash KumarversusThe State of Bihar

Decided
Disposal

Holding

The appeal is allowed; the order rejecting bail is set aside and the appellant is entitled to bail on condition.

Summary

The appellant, Om Prakash Kumar, was charged under IPC sections 365, 302, 394, 120B and 34, and Section 3(2)(v) of the SC/ST (Prevention of Atrocities) Act for the murder of a sand‑truck driver. The Special Judge had rejected his bail application, relying mainly on a confessional statement of a co‑accused, Subodh Mahto. The appellant contended that he was falsely implicated, had no prior criminal record, and that a similarly situated co‑accused, Ranjeet Kumar, had been granted bail in a related case. The State opposed the bail. After hearing both sides, the Patna High Court set aside the lower court’s order, allowed the appeal, and directed that the appellant be released on bail upon furnishing a Rs.10,000 bond with two sureties.

Issues considered

  • Whether the appellant is entitled to bail despite the serious nature of the offences charged under the IPC and the SC/ST Act.
  • Whether the confessional statement of a co‑accused alone suffices to deny bail.
  • Whether the grant of bail to a similarly situated co‑accused influences the bail decision for the appellant.

that appellant is innocent and he has been falsely implicated in

          since 17.01.2025.

                       5. The appeal for bail is vehemently opposed by

learned Spl. P.P. for the State.
