The court held that the allegations prima facie do not amount to an offence under the SC/ST Act as the matter is a civil land dispute and no public caste insult is established.
Summary
Jamadar Mahto was accused of dispossessing Sundarpati Devi of land allotted to her under a government scheme, leading to a complaint under IPC sections 323, 341, 504 and SC/ST (Prevention of Atrocities) Act sections 3(i)(r)(s). The appellant challenged the Special Judge's order granting bail, invoking Section 14A(2) of the SC/ST Act. The High Court examined whether the dispute was essentially civil and whether any caste-based abuse was made in public view, finding the allegations insufficient to sustain an offence under the SC/ST Act. Relying on precedents that require a public caste insult for an atrocity charge, the Court held the complaint prima facie civil. Consequently, the Court set aside the lower court’s order, directed the appellant’s release on bail with conditions, and allowed the appeal.
Issues considered
- Whether the allegations against the appellant constitute an offence under the SC/ST (Prevention of Atrocities) Act.
- Whether the dispute is essentially civil in nature and thus outside the ambit of the SC/ST Act.
- Whether the alleged caste-based abuse was made in public view, satisfying the requirement for an atrocity offence.
- Whether bail should be granted to the appellant under Sections 438(2) and 482(2) of the Cr.P.C.
