The appeal is allowed; the order of the trial court is quashed and bail is granted to the appellants.

Summary

The appellants, eight members of a family, were charged under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act for assaulting an informant with brick plates and allegedly abusing her caste name. They appealed to the Patna High Court under Section 14A(2) of the Act against the order of the District and Additional Sessions Judge. The court noted that the FIR’s description of the physical assault was vague and that the alleged caste abuse was not made in public view. Relying on the Supreme Court’s decision in Hitesh Verma v. State of Uttarakhand, the court held that such general and omnibus allegations do not justify denial of bail. Consequently, the High Court directed that all eight appellants be released on bail with a bond of Rs.10,000 and two sureties each, subject to Section 438(2) of the Cr.P.C., quashed the impugned order dated 27.08.2025, and allowed the appeal.

Issues considered

  • Whether the allegations of physical assault and caste-based abuse in the FIR are sufficient to deny bail under the SC/ST (Prevention of Atrocities) Act.
  • Whether caste-based abuse must be made in public view to constitute an offence under the Act.
  • Whether the appeal filed under Section 14A(2) of the Act is within the limitation period prescribed under Section 14A(3).
