The High Court set aside the order of the Exclusive Special Judge, granted bail to all four appellants, and allowed the appeal.

Summary

The appellants, four men from Rashulpur Kori Gaon, were charged under several sections of the Bihar Penal Code and the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act for allegedly assaulting an informant and using caste-based abusive language. They contended that the allegations of assault were vague and that the alleged caste abuse was not made in public view, arguing that the case was retaliatory. The appellants filed an appeal under Section 14A(2) of the SC/ST Act challenging the bail order dated 19‑08‑2025 passed by the Exclusive Special Judge, asserting that the appeal was within the limitation period prescribed by Section 14A(3). The High Court, after hearing the parties, held that the physical‑assault allegation was omnibus and that the caste‑abuse allegation did not appear to have been made publicly, and therefore granted bail to the appellants, quashing the impugned order. Consequently, the appeal was allowed.

Issues considered

  • Whether the appeal filed under Section 14A(2) of the SC/ST (Prevention of Atrocities) Act is within the limitation period of Section 14A(3).
  • Whether the allegations of physical assault and caste‑based abuse are sufficiently specific and made in public view to justify denial of bail.
  • Whether the order dated 19‑08‑2025 passed by the Exclusive Special Judge should be set aside.
  • Whether bail can be granted under Section 438(2) of the Criminal Procedure Code in the circumstances.
