Holding

The Court held that the appellant is not entitled to bail and dismissed the appeal.

Summary

The appellant, Ritesh Kumar, was charged under Sections 103(1) and 61(2) of the BNS for allegedly firing at a deceased person, who was later killed by another individual, Ashish Kumar. He was in custody from 15 April 2025 and applied for bail in a Special Child Case. The trial court denied bail, prompting an appeal to the Patna High Court. The High Court examined the prosecution's case and the circumstances of the alleged offence. Finding no sufficient ground to justify release, the Court upheld the lower court's decision and dismissed the appeal.
